Environmental Litigation Takes Dramatic Shift Driven by Human Health Vapor Intrusion Liability. The presentation was given in the Hill Carrillo Adobe in Santa Barbara on October 21, 2015. The lecture covered the emergence of class action suits involving vapor intrusion sites in the United States. Costs of soil and groundwater site cleanup were compared with long term liability caused by volatile site contamination entering homes and office buildings causing human health risks and potential explosions. The presentation was approved for Minimum Continuing Legal Education (MCLE) credit required of attorneys.

Everett & Associates have been appointed to serve as technical advisor to the Exide Community Advisory Group, working with South Coast Air Quality Management District and California Department of Toxic Substances Control on environmental issues related to cleanup of lead and other contaminants from the former Exide secondary lead smelter in Vernon, California. Dr. Wells has a particular area of expertise in the fate and transport of metals in the environment.

New Research Reveals Shortcomings in Vapor Intrusion Investigations

There is a growing body of research pointing to very significant temporal and spatial variability in vapor intrusion, which is a contaminant transport mechanism that can lead to the occurrence of toxic chemicals in indoor air. Current sampling protocols, as recommended by many environmental regulatory agencies will not adequately characterize such dynamic behavior, possibly leading to flawed decision-making regarding the risks posed by vapor intrusion.

LEAís Bill Schaal, PG, recently made a presentation related to metal element contamination to regulatory staff at the California Department of Substances Control (DTSC) in Chatsworth, California. Bill was joined Jeff Hess, PG, Technical Director of Gilbane Company. Bill and Jeff, together with colleague, Mark Sorensen, PG, are advancing the state-of-the-art within the environmental industry by applying geochemical methods to determining whether metal elements are naturally occurring or anthropogenic (man-made). The present state-of-practice within the environmental industry relies heavily on professional judgment, limited statistical analysis, and analytical methods that were developed to evaluate bioavailable compounds thus were not intended for this purpose.
